CHAPTER I
CONSTITUTION AND BY-LAWS
OF
THE DAYTON EDUCATION ASSOCIATION

ARTICLE ONE -- NAME
This organization shall be known as the Dayton Education Association (a non-profit
corporation organized under the laws of the State of Ohio).
ARTICLE TWO -- MISSION STATEMENT
We, the Dayton Education Association, will encourage professionalism; advocate
the rights of members; and demonstrate a positive commitment to the enhancement
of "Public Education."
ARTICLE THREE -- PURPOSE
The purposes of this organization shall be:
Section 1 To adopt and to promote the Code of Ethics of the United Education
Professions.
Section 2 To enable members to speak with a common voice on matters pertaining to the education profession and to represent their individual and common interests before the Board of Education and/or other legal authorities and to encourage active participation of professional staff members in the solution of school problems.
Section 3 To unify and to strengthen the education profession and to secure and maintain the Master Contract.
Section 4 To secure the cooperation of other groups in order that conditions essential to professional service may be maintained.
Section 5 To hold property and funds and to employ a staff for the attainment of these purposes.
Section 6 To promote membership in the United Education Professions.
ARTICLE FOUR -- AFFILIATIONS
Section 1 The Dayton Education Association shall be affiliated with the Western Ohio Education Association, the Ohio Education Association, and the National Education Association.
Section 2 The Dayton Education Association shall comply with the Ohio Education Association Standards for Associate organizations, as found in the OEA Constitution and By-Laws.
ARTICLE FIVE -- MEMBERSHIP
The Dayton Education Association shall have two types of members; (A) Full
time certified members, and (B) Half time certified members. Consistent with
the Code of Ethics of the education profession, membership in the Association
shall be open to all educators regardless of race, creed, sex, martial status,
or national origin, or sexual orientation.
All Full-time and Half-time certified members shall have the right to vote;
hold office; attend all BAR meetings; attend or be a delegate to all district,
state and national representative assemblies, and receive all member benefits
provided by the UEP.
Section 1 All Full-time professional staff members employed by the Dayton Board
of Education, except those classified as administrators, shall be eligible
for Full-time membership. Full-time membership shall be available to all Professional
Staff Members who work four (4) or more hours per day.
Section 2 Half-time certified membership shall be available to all Professional
Staff Members employed by the Dayton Board of Education who work less than
four (4) hours per day.
Section 3 According to procedures adopted by the Representative Assembly, the Representative Assembly may suspend from membership or expel any member who shall have violated the Code of Ethics of the United Education Professions. In such cases a member shall have the right of appeal, including a hearing before the Executive Board. The Representative Assembly may reinstate a member who has previously been suspended or expelled from the Association only upon an application approved by a 2/3 vote of the Representative Assembly by secret ballot.
ARTICLE SIX -- OFFICERS
Section 1 Officers of the Association shall be a President, Vice-President,
Secretary, and Treasurer.
All officers shall be members of the United Education Professions, and shall be elected by the general membership.
Section 2 The newly elected officers shall take office July 1 and shall hold office through June 30 of the following year. All officers shall hold office for a period of two (2) years and may serve a maximum of three (3) consecutive terms.
ARTICLE SEVEN -- STAFF
Section 1 Secretarial/Clerical Staff:
The Secretarial/Clerical staff shall be employed by the Dayton Education Association.
The Dayton Education Association shall be an equal opportunity employer and
shall not discriminate on the basis of race, creed, sex, marital status, national
origin, or sexual orientation. This staff will be responsible to the Officers
and the Executive Board of the DEA and to the OEA Labor Relations Consultant.
Section 2 The Labor Relations Consultant:
The Labor Relations Consultant shall comply with the OEA UniServ Delivery Plan,
and shall serve as an advisor and a consultant to the President, the Executive
Board, the Representative Assembly, and the membership.
ARTICLE EIGHT -- EXECUTIVE BOARD
Section 1 The Executive Board shall be composed of the elected officers and committee chairpersons of the Association, the immediate past president, the area representatives, and the Doris L. Allen Minority Caucus representative. The term of the immediate past president shall be for two years.
For the 1998-99 school year only, the DLAMC Minority Caucus Representative will be appointed by the DEA President, recommended to the Executive Board, and may sit on the Executive Board as an ex-officio member. The DLAMC representative shall be elected by the DEA members at the general election in May, 1999.
(An ex-officio member does not have voting privileges, cannot make a motion,
nor be present during executive session.)
Section 2 The Executive Board shall be the executive authority of the Association.
ARTICLE NINE -- REPRESENTATIVE ASSEMBLY
Section 1 The Building Association Representative Assembly shall be composed of the Executive Board and the elected representatives from each school.
Section 2 The Building Association Representative Assembly shall be the supreme
governing body of the Dayton Education Association and shall perform such functions
as stipulated in the By-Laws.
Section 3 Any member of the Association who is not a delegate to the Building
Association Representative Assembly may attend its meetings. They shall sit
in the section reserved for non-delegates.
Section 4 The Building Association Representative Assembly may determine its rules of procedure. In the absence of special rules, it shall be guided by Robert's Rules of Order, Revised.
ARTICLE TEN -- AMENDMENTS
Section 1 Amendments to this Constitution shall be proposed in writing to
the Building Association Representative Assembly by the Executive Board, or
by a Constitution Revision Committee, or by an initiative petition signed by
ten percent 10% of the members of the Dayton Education Association and verified
by the Treasurer.
Section 2 The Building Association Representative Assembly may adopt amendments
to this Constitution by a 2/3 majority of that body. Amendments shall have
been introduced at the regular meeting of the Representative Assembly preceding
that at which the vote will be taken and copies of the proposed amendments
shall have been distributed to members for discussion.
Copies shall be available to those in attendance at the voting meeting.
